Terms of Use

These Terms govern the rights, obligations and responsibilities relating to use of sm-electric.co.kr and related services operated by SM ELECTRIC Co., Ltd. (the "Company"). Individual service contracts are governed by their respective separate agreements.

General Provisions

Article 1 (Purpose)

The purpose of these Terms is to set out the rights, obligations and responsibilities between the Company and users with respect to use of the website (sm-electric.co.kr) and related services (the "Services") provided by the Company.

Article 2 (Definitions)

  • User — a person who agrees to these Terms and uses the Company's Services.
  • Client — a corporation or individual that has entered into a separate service contract with the Company.
  • Content — all materials provided by the Company within the Services (text, images, documents, video, etc.).
  • Individual Services — services provided under separate contracts, such as PV/ESS monitoring, O&M, PMS(EMS), pre-inspection, drone thermography and battery diagnostics.

Article 3 (Posting and Amendment of the Terms)

The Company posts these Terms on its website at all times. When the Terms are amended, the Company gives notice at least 7 days before the effective date (at least 30 days in advance for changes unfavorable to users).

Use of the Services

Article 4 (Provision of Services)

  • Viewing public information such as company profile, business areas, services and project records
  • Material downloads (company profile, catalogs, case books, etc.)
  • Requesting quotes and consultations through inquiry forms

Article 5 (Service Hours and Suspension)

The Services are, in principle, provided 24 hours a day, year-round. However, they may be temporarily suspended in the event of system maintenance, replacement or failure, communication outages, force majeure or similar causes.

Article 6 (Obligations of Users)

  • Comply with applicable laws and the provisions of these Terms
  • Refrain from acts that interfere with operation of the Services (automated access, abnormal downloading, etc.)
  • Refrain from infringing the rights or reputation of others and from posting false information

Intellectual Property and Content

Article 7 (Copyright)

The copyright in all Content within the Services belongs to the Company or the rightful holder. Users may not reproduce, distribute, transmit, display or publish Content without the Company's prior written consent.

Article 8 (Material Downloads)

Company profiles, catalogs, project portfolios, case books and similar materials provided by the Company may be used only for internal review for the purpose of evaluating the Company, and may not be delivered or posted to third parties without authorization.

Article 9 (Use of Trademarks)

"SM Electric" and the related logos and designs are trademarks or works of the Company, and unauthorized use is prohibited.

Liability and Damages

Article 10 (Disclaimer)

  • Service interruptions due to causes beyond the Company's control, such as force majeure, power outages and communication failures
  • Damages arising from causes attributable to the user
  • The accuracy and reliability of information posted or transmitted through the Services by third parties
  • General information posted on the website is for reference only; actual contract terms are governed by the individual contract.

Article 11 (Damages)

Where the Company or a user causes damage to the other party by breaching these Terms, the party that caused the damage shall be liable for compensation in accordance with applicable law.

Dispute Resolution

Article 12 (Governing Law)

The laws of the Republic of Korea shall be the governing law for the interpretation of these Terms and for disputes between the Company and users.

Article 13 (Competent Court)

The court with jurisdiction over any dispute arising between the Company and a user in connection with use of the Services shall be the competent court under the Civil Procedure Act.

Article 14 (Dispute Mediation)

Before filing a lawsuit, both parties shall give priority to resolving disputes through consultation in accordance with the principle of good faith. If no agreement is reached, the parties may follow mediation by relevant bodies such as the Korea Fair Trade Mediation Agency or the Seoul Central District Court.
